What is Pennsylvania workers' compensation?

What injuries are covered by the Workers' Compensation Act?
Any worker who has sustained an injury arising out of, and in the course of, their employment has a potential workers' compensation claim. You are covered if you were injured while traveling on business, performing work-related errands, attending a required social function, or even while on a break or using the restroom facilities. In short, any injury or illness that happens while you are at work is a work injury.

Do I need a workers' compensation attorney?
Yes. An attorney is very important to see that your benefits are properly protected. You may hear from a very nice insurance claims adjuster regarding your claim. The problem with taking advice from an insurance adjuster is that the adjuster's motivation for making decisions is to keep costs down and profits up. This goal is in direct conflict with your best interests, which are to obtain the best medical care and ongoing wage loss benefits for as long as you are unable to return to work. An insurance adjuster is trained to reduce the costs of the claim in any way possible, even to the extent of violating the provisions of the Workers' Compensation Act. Although the Pennsylvania Workers' Compensation Act provides for penalties for insurance company misconduct, those provisions do not seem to keep violations to a minimum.
Can I still receive benefits if the injury was my fault?
Yes. You are entitled to all of the benefits provided under the Pennsylvania Workers' Compensation Act, even if you are at fault. This is an issue to discuss in further detail with your lawyer.

No. It is against the law for your employer to fire you because you have filed a claim or have retained an attorney.
